Note 7 Owners Launch Class Action Lawsuit Against Samsung

Galaxy Note 7 owners have launched a class action lawsuit against Samsung after at least 112 of the smartphone handset models have exploded. The suit, launched by three plaintiffs in New Jersey, US, accuses Samsung of not acting quickly enough when first reports of defective handsets became public, leaving them without functional phones for several weeks before the recall notice was issued and of failing to compensate customers left with the ongoing cost of phone contracts with network providers.

“Samsung informed consumers they would have to wait several days, and even weeks in many cases, before receiving a replacement smartphone,” the suit, brought by McCuneWright on behalf of the plaintiffs, reads. “During this time, and as a result of Defendant failing to provide consumers with an adequate replacement, consumers continued to incur monthly device and plan charges from their cellular carriers for phones they could not safely use.”

“Samsung has agreed to recall and reimburse the cost of the device, but their customers have had to continue to pay on their data and voice plans during the time they had to make their device inoperative until they received their replacement device,” lawyer Richard McCune told Vice Motherboard. “That is the loss that the case is focused on.”

Samsung has said that it does not comment on pending litigation.
